1031 Exchange Facilitator Should be a Tax Expert

The powerful 1031 exchange that will save your investors tens of thousands in tax, is named after the Internal Revenue Tax Code Section 1031.  So why wouldn’t the Facilitator you recommend be a tax professional instead of an attorney?

Some attorney facilitators are very astute when it comes to tax law and how the IRS looks at the 1031 process, but most do not have the years of intense tax experience that a tax professional does.  Tax professionals are dealing with the IRS on a daily basis.

The typical attorney who does 1031 exchanges does not have the familiarity with dealing with the IRS because they are not proactively working with the IRS on various situations on a daily basis.
In the state and federal tax arena, we have to be creative and the responses from tax courts and tax agents in general give us a great basis from which to make decisions as to how to handle the various property exchanges.  Each 1031 is different, creativity and experience are critical.

Build it right the first time.
